1. Services Provided

DCustomize LLC provides expert digital marketing services, including but not limited to:

  • Email & SMS Marketing Automation: Setup, management, and optimization of flows (specifically via Klaviyo and similar platforms).

  • Audit Services: Comprehensive reviews of existing marketing infrastructures.

  • Retention Retainers: Ongoing strategic management and execution of digital marketing campaigns.

2. Client Responsibilities

To achieve the best results, clients must provide:

  • Timely access to necessary platforms (Klaviyo, Shopify, etc.).

  • Accurate business data and branding assets.

  • Approval of marketing materials within the agreed-upon timelines.

3. Fees and Payment

  • Payment Terms: Fees for “Core Flow Setup” are due as outlined in the specific project proposal. Monthly “Retention Retainers” are billed in advance of each service period.

  • Currency: All transactions are processed in USD unless otherwise agreed upon in writing.

  • Late Payments: We reserve the right to suspend services if payments are not received within the specified timeframe.

4. Limitation of Liability

DCustomize LLC works to maximize your revenue through optimized automation. However, we are not liable for:

  • Revenue loss due to third-party platform outages (e.g., Klaviyo, Shopify, or Meta).

  • Technical issues arising from client-side changes to website code or integrations.

  • Indirect, incidental, or consequential damages resulting from the use of our services.

5. Intellectual Property

All custom strategies, email templates, and copy created for a client become the property of the client upon full payment of all related invoices. DCustomize LLC retains the right to use anonymized data and screenshots of work for portfolio and marketing purposes.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
